A civil lawsuit in the US is fundamentally different than in Germany and most other countries. Following the filing of the Complaint, the US judge does not actively collect the evidence. Rather, the parties collect the evidence and typically present it to a judge or jury at a final hearing called a “trial”. Before the trial, the parties can attempt to force witnesses to testify under oath, request parties and non-parties to produce documents, request parties to answer written questions, and otherwise act to discover the pertinent facts.

If a civil trial is conducted before a jury, which generally consists of 6 ordinary citizens, it is possible to obtain a large money judgment because, at times, a jury will make decisions, at least in part, based on instincts and/or emotions.

Civil litigation in Florida can be lengthy and costly. Unlike in Germany, there is no Florida statutory attorneys’ fees schedule governing civil disputes, so some cases are handled on an hourly fee basis. However, cases involving personal injury, medical malpractice, automobile accidents, airplane crashes, etc., are typically handled on a contingency fee basis, with the attorneys being paid an agreed percentage of the money collected, and with the client paying no attorneys’ fees unless there is a successful outcome.
